Dial-Up Usage Policy

Bauer Communications Network is a PRIVATE Internet Service Provider and a division of Bauer Communications Company. We can be found at www.BauerCom.net This service was designed around what we wanted for our family, friends, and employees. We have created a place that is family friendly and free of the pornography, which is so prevalent on the Internet. We have also provide interesting links in numerous categories as an easy starting point for surfing the web.

The cost for a standard account is $19.95 per month and includes 1 e-mail box and 3 MB disk storage for e-mail or a personal or business web page. Payment may be made by Credit Card or from a Checking account, which is automatically deducted at the first of each month. Visa, MasterCard, Discover, and American Express accepted. If you would prefer to write a check we will bill you at the beginning of each quarter for the next three months service. Discounts for paying a year in advance are available and bring the price down to $15.95 per month

We highly recommend a Pentium class computer running Windows 95, a CD ROM drive, 16 MB of Ram, and at least a 28.8 modem. Minimum requirements are at least 8 MB of Ram, 70 MB of free hard disk space and a 14.4 Modem.

LICENSE AGREEMENT BAUER COMMUNICATIONS NETWORK IS A PRIVATE INTERNET SERVICE PROVIDER AND A DIVISION OF BAUER COMMUNICATIONS COMPANY. BAUER COMMUNICATIONS NETWORK PROVIDES YOU WITH AN INTERNET ONRAMP. WE DO NOT PERFORM COMPUTER DIAGNOSIS, MAINTENANCE, OR REPAIRS. BY USING THE BAUER COMMUNICATIONS INTERNET SERVICE, YOU ACKNOWLEDGE THAT ITS PRIMARY PURPOSE IS TO DENY THE ACCESS TO INTERNET SITES THAT WE FEEL MIGHT BE CONSIDERED OBJECTIONABLE. AS A RESULT CERTAIN SITES MAY BECOME UNAVAILABLE TO YOU EVEN THOUGH YOU MAY NOT DEEM THE CONTENTS OF THOSE SITES EITHER OFFENSIVE OR OBJECTIONABLE. ALSO, BAUER COMMUNICATIONS CANNOT AND DOES NOT GUARANTEE THAT SITES WILL BE BLOCKED WHICH YOU OR ANY OTHER PERSON DEEM OFFENSIVE OR OBJECTIONABLE. BAUER COMMUNICATIONS DOES NOT WARRANT THAT THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY DEFECTS IN THE SERVICE WILL BE CORRECTED. LIMITATION OF LIABILITY BAUER COMMUNICATIONS WILL NOT UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY DAMAGES WHATSOEVER RESULTING FROM THE USE OR LOSS OF USE OF THE SERVICE UNDER ANY CIRCUMSTANCES, DUE TO ANY CAUSE, EVEN IF BAUER COMMUNICATIONS HAS BEEN TOLD OF THE POSSIBLE DAMAGES. BAUER COMMUNICATIONS IS NOT RESPONSIBLE FOR ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES SUFFERED BY THE SUBSCRIBER INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, NON-DELIVERIES, LONG DISTANCE CHARGES OR SERVICE INTERRUPTIONS FOR ANT REASON. BAUER COMMUNICATIONS TOTAL LIABILITY TO YOU FOR ALL DAMAGES (WHETHER BASED ON CONTRACT, TORTE, OR OTHER THEORIES) WILL BE LIMITED TO THE AMOUNT YOU ACTUALLY PAID FOR THE SERVICE DURING THE MONTH IN QUESTION. PAYMENT POLICY BAUER COMMUNICATIONS IS HEREBY AUTHORIZED TO DEBIT YOUR ACCOUNT FOR THE AMOUNT OF THE SERVICE AND SETUP FEE AS SEEN ON THE SIGNUP WEBPAGE. IF CREDIT CARD IS DECLINED ON THE ANNIVERSARY DATE OF YOUR SIGNUP THEN YOU WILL HAVE SEVEN DAYS TO CONTACT BAUER COMMUNICATIONS AND AUTHORIZE ANOTHER PAYMENT. AFTER 2 DAYS YOUR ACCOUNT WILL BE FROZEN. AFTER THE SEVEN DAYS GRACE PERIOD YOU WILL BE CHARGED A TEN-DOLLAR REACTIVATION FEE. EXTRA SERVICES LIKE ADDITIONAL EMAIL ETC. WILL ALSO BE CHARGED ON YOUR CREDIT CARD. CANCELLATION POLICY YOU CAN CANCEL BY CALLING BAUER COMMUNICATIONS BY TELEPHONE AT LEAST 10 DAYS BEFORE YOUR NEXT ANNIVERSARY DATE OF YOUR ACCOUNT. AFTER THAT TIME YOU WILL BE CHARGED FOR THE NEXT MONTHS PAYMENT. BAUER COMMUNICATIONS RESERVES THE RIGHT TO CANCEL SERVICE TO ANY CUSTOMER FOR ANY REASON THEY DEEM FIT. REASONS INCLUDE: ATTEMPTING MULTIPLE LOG-INS ATTEMPTING TO GAIN UNAUTHORIZED ACCESS TO, OR TAMPERING WITH, EITHER OUR NETWORK OR ANY OTHER NETWORK, OR ATTEMPTING TO GAIN UNAUTHORIZED ACCESS TO OTHER USERS ACCOUNTS. THIS INCLUDES SENDING MALICIOUS PROGRAMS TO ANY USER. HARASSING OR THREATENING USERS VIA THE INTERNET. SPAMMING USE OF THE SYSTEM TO DISTRIBUTE AND/OR STORE ILLEGAL COPIES OF COMMERCIAL SOFTWARE. USE OF THE SYSTEM TO DISTRIBUTE AND/OR STORE PORNOGRAPHIC MATERIALS. FORGE ELECTRONIC MAIL OR OTHERWISE MISREPRESENT YOURSELF IN ELECTRONIC MAIL. THIS INCLUDES ALTERING THE 'FROM' ADDRESS IN A MESSAGE TO POINT TO SOME OTHER ACCOUNT WE RESERVE THE RIGHT TO LIMIT ONLINE SESSIONS. WE RESERVE THE RIGHT TO AMEND THESE RULES WITHOUT PRIOR NOTICE.

We allow one dial-up per user account. Don’t share your access codes with other people. If someone logs in to your account while you are logged in, you will be billed $20.00 for each simultaneous log in.

YOU MAY NOT:

Have multiple log ins.
Attempt to gain unauthorized access to, or tamper with, either our network or any other network, or attempt to gain unauthorized access to other users accounts. This includes sending malicious programs to any user.
Harass or threaten users via the Internet.
Run any kind of "bot".
Flood or "Spam" Usenet or send unsolicited bulk e-mail.
Use the system to distribute and/or store illegal copies of commercial software.
Use the system to distribute and/or store Pornographic materials
Forge electronic mail or otherwise misrepresent yourself in electronic mail. This includes altering the ‘From’ address in a message to point to some other account
Have unattended sessions. This is where it is unlikely that you are directly using system resources.
Use excessive system resources

We reserve the right to limit online sessions.
We reserve the right to amend these rules without prior notice.
We reserve the right to terminate an account for any reason.
Violation of these rules will bring about prompt removal from the system.

If a user breaks the rules, Bauer Communications may suspend a user’s account without prior notice. That account will be marked for deletion in 30 days. If your account is suspended contact us at (#689-0893). If deletion is necessary because of the user breaking the rules, no refunds will be given for the current month. The content of the account will be deleted and not backed up. The use of Bauer Communications’ services to engage in any unlawful act is prohibited and will result in termination of service, and the appropriate authorities will be notified.

Bauer Communications makes no warranties; either express or implied, including any warranties of merchantability or fitness of any provided services for any particular purpose. Bauer Communications is not responsible for any indirect, consequential, or incidental damages suffered by the subscriber including, but not limited to, loss of data, non-deliveries, or service interruptions for any reason.

Use of any information obtained via Bauer Communications’ Internet Service is understood to be at the user’s own risk. Some material found on the Internet may be considered objectionable; however, Bauer Communications is not responsible for the contents of documents on the Internet. We proved a filter to help our customers prevent pornography from coming into their homes or offices, however no filtering system can be 100% effective because the Internet changes daily. The filtering system constantly patrols the Internet for new problem sites and quickly eliminates them. As many as 3% of these sites may get through at any given time. Bauer Communications recommends that parents supervise their children while on the Internet.

    The Internet is a vast resource where all kinds of people go for information and entertainment. Please go out and enjoy. There is so much to see and do on the Internet.
    Protect yourself: If you enter a chat room don’t give out your name, address, phone number, or e-mail address. Don’t give out banking information, checking account or credit card numbers except in a secured server at a well-known reputable business. If you must post your e-mail address in a public place, add an asterisk or other symbols to the front of your address and tell people to delete it when mailing you. Web Bots search these areas for names to sell to junk e-mail houses. If you find yourself receiving junk, offensive or harassing e-mail, notify us. We will delete that e-mail account and assign you a new one at no charge.
    Our system resources are calculated on an honor system, so don’t allow your friends to use your account. If you need system resources, use them. However, if you are not at your computer, actively surfing, please disconnect so others may use the lines.

FILTER DISCLAIMER:

THE FILTER SOFTWARE AND PROHIBITED SITE DATABASE ARE PROVIDED "AS IS." UNDER NO CIRCUMSTANCES WILL EITHER THE FILTERING COMPANY OR YOUR INTERNET SERVICE PROVIDER OR BOTH BE HELD LIABLE TO YOU OR ANYONE ELSE FOR ANY CONSEQUENTIAL, SPECIAL, OR INDIRECT DAMAGES RESULTING FROM THE POSSESSION, USE, OR MALFUNCTION OF THIS PRODUCT, INCLUDING WITHOUT LIMITATION, DAMAGE TO PROPERTY AND DAMAGES FOR PERSONAL INJURY, EVEN IF THE FILTERING COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES OR LOSS. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THUS THE PRECEDING LIMITATIONS MAY NOT APPLY TO YOU. YOU AGREE THAT THE LIABILITY OF THE FILTERING COMPANY AND/OR OF YOUR INTERNET SERVICE PROVIDER ARISING OUT OF ANY SORT OF LEGAL CLAIM (WHETHER IN CONTRACT, TORT, OR OTHERWISE) WILL NOT EXCEED THE AMOUNT YOU ORIGINALLY PAID FOR THE USE OF THIS PRODUCT.

Business domain web hosting requires one standard Internet access account plus the charges listed below.
Web hosting includes 10 MB of disk space, 500MB of bandwidth per month and 1 additional e-mail box.

At Bauer Communications we are happy to recommend people and or Companies to repair your computers, do network trouble shooting and design your web sites. For all work of any kind or nature that we do for you is charged at a flat rate of $150.00 per hour including travel time.

Extra storage space and e-mail boxes are available at additional cost. No business or personal account may exceed 500 MB of bandwidth per month without additional charges. Bandwidth limitations apply only to your personal or business web pages. For example: If 500 people visit your web page and your site has 1MB of information on it, you will have used up your allotment of bandwidth for the month.

PRESONAL AND BUSINESS WEB HOSTING

Bauer Communications makes no warranties, express or implied, as to the suitability of its products and services for any purpose whatsoever. You use Bauer Communications entirely at your own risk

Bauer Communications shall not be liable for any damages whatsoever ( including, without limitation, damages for loss of business provides, business interruption, loss of business information, loss of any kind of data, including the entire website, or any other pecuniary loss) arising out of the use or inability to use Bauer Communications products and services, even if Bauer Communications has been advised of the possibility of such damages.

Your website may not contain or link to anything that appears to contain Pornographic, Satanic, Illegal, Violent, Dishonest, or just poor taste. Bauer Communications will be the sole judge of the propriety of your Website. We reserve the right to remove an offending page or the entire Website. Remember Bauer Communications is a Family Oriented Service. If you would be embarrassed to show your website to your Pastor or your child's Sunday School Class, than it doesn't belong on our servers.

Bauer Communications reserves the right to refuse or terminate service for any reason.

Bauer Communications bears no responsibility for the nature and content of your Website.

You bear the entire responsibility for the nature and content of your Website.

You bear the entire responsibility for all the legal and professional cost of your Website.

You bear the entire responsibility for all the legal costs Bauer Communications incurs as a direct result of your Website. This includes, but is not limited to, the cost to collect on past due amounts.

Bauer Communications reserves the right to collect 1.5 percent per month on all past due accounts.

If any part of this agreement is found to be legally unenforceable, only that part may be stricken from this agreement. The rest of this agreement will remain in effect.

By continuing to use Bauer Communications you imply that you agree to the current Terms and Conditions of use.
